What is an Authorised Representative Explained

The 2014 WEEE regulations (S.I. 149 of 2014) introduced a new requirement for Producers based outside of Ireland to appoint an “Authorised Representative”. Therefore if you are a Producer based within the Republic of Ireland, this requirement may not apply to you.

What is an Authorised Representative?

An Authorised Representative for our members (where applicable) is any natural or legal person established within the Republic of Ireland who has been appointed by written mandate from a Producer based outside of the Republic of Ireland, to fulfil that Producer’s obligations as required in the Irish State for the placement of EEE onto the Irish market.

 

Do I require an Authorised Representative?

Under the regulations (S.I. No. 149 of 2014) Authorised Representatives can apply to two forms of Producer:

 

1) Do you supply direct to the end-user?

If you are a Producer based outside of the Republic of Ireland and are supplying EEE directly to end-users on the Irish market by means of distance communication then you require the appointment of an Authorised Representative to fulfil your Producer obligations within the Irish State.

 

2)  Do you supply to an Irish based distributor?

If you are a Producer based outside of the Republic of Ireland and are supplying EEE to Distributors on the Irish market, then you may, by way of exception to regulation 3(1) appoint an Authorised Representative to fulfil your Producer obligations within the Irish State.

 

How does an Authorised Representative impact my WEEE Ireland Membership?

If your company appoints an Authorised Representative you will still remain Members of the WEEE Ireland Scheme, signing the Rules of Membership directly for your certification.

Appointment of an Authorised Representative however must be confirmed with us via written mandate, and for our records we require that this is drawn up on your Producer organisations headed paper.
